Families Moving Forward (FMF) Website Terms of Use

These terms and conditions of use (“Terms of Use”) govern your access to and use of this website and any page contained herein, including all website pages whose URL includes “familiesmovingforwardprogram.org,” or “familiesmovingforwardprogram.com,” all of which are collectively referred to below as the “FMF Website,” owned and controlled by Seattle Children’s Hospital (“Seattle Children’s”). Please read the following information carefully before accessing the FMF Website. Your continued use of the FMF Website indicates your agreement and acceptance of the following terms and conditions. If you do not agree to be bound by these terms, you are not authorized to access or use the FMF Website; promptly exit the FMF Website.

We reserve the right at any time to, among other actions:

  • Change these Terms of Use;
  • Change the FMF Website, including eliminating or discontinuing any content on or feature of the FMF Website; or
  • Deny or terminate your use of and/or access to the FMF Website.

Any changes we make will be effective immediately upon our making such changes available on the FMF Website or otherwise providing notice thereof. We may provide notice of any such changes by posting an updated version of these Terms of Use with the date of the update set forth below. You agree that by entering, re-entering, or continuing to use the FMF Website thereafter, you accept any and all such changes. Be sure to return to this page periodically to ensure familiarity with the most current version of these Terms of Use.

Eligibility; Website Access, Security, and Restrictions; Passwords

To participate as an FMF Trainee and become an FMF Specialist, or to deliver FMF content at your agency, qualified individuals must apply for FMF Program Training. If you work for an agency or organization, you may contact us at fa*******************@se**************.org to enquire about additional training options. Once your application has been approved for training and you have paid all related fees, you must also register for access to the FMF Client Portal.

During your FMF Client Portal registration, you will create a unique username and password to access the FMF Client Portal. The username and password are personal to you, and you are solely responsible for maintaining the confidentiality of your username and password, and for all activities that occur under such username and password. You agree to prohibit anyone else from using your username and password and agree to immediately notify the Families Moving Forward Program of any actual or suspected unauthorized use of your username and password or other security concerns of which you become aware. Your access to the FMF Website may be revoked by Seattle Children’s at any time with or without cause.

You are prohibited from violating or attempting to violate the security of the FMF Website, including, without limitation: (a) accessing data not intended for you or logging onto a server or an account which you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; or (c) accessing or using the FMF Website or any portion thereof without authorization, in violation of these Terms of Use or in violation of applicable law.

You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the FMF Website or any activity being conducted on the FMF Website.

Ownership of the FMF Website and Related Materials; Additional Restrictions

All pages within the FMF Website and any material made available for download are the property of Seattle Children’s, its licensors, or the identified authors or copyright holders as applicable. The FMF Website is protected by United States and international copyright and trademark laws.

Subject to these Terms of Use, Seattle Children’s grants you a revocable, nontransferable (except as provided below), personal, non-exclusive license to use the FMF Website for education, FMF Specialist Training, FMF Intervention Fidelity Training, research, and providing the FMF behavioral consultation intervention as a trained provider. All rights not expressly granted to you in these Terms of Use are reserved and retained by Seattle Children’s, its licensors, suppliers, publishers, rights holders, or other content providers.

Without limiting any of the foregoing, you may not:

  • Reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit the FMF Website or any part of the FMF Website for any commercial purpose without express written consent of Seattle Children’s;
  • Frame or utilize framing techniques to enclose or deep link to any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Seattle Children’s without express written consent of Seattle Children’s;
  • Use any meta tags or any other “hidden text” utilizing Seattle Children’s name or trademarks without the express written consent of Seattle Children’s;
  • Attempt to disable, “hack” or otherwise interfere with the proper functioning of this website;
  • Upload or transmit any communications or content of any type that may infringe or violate any rights of any party;
  • Use this website to post or transmit material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful or embarrassing to any other person or entity;
  • Use this website as a means to distribute advertising or other unsolicited material to any third party;
  • Use this website for any purpose in violation of local, state, national or international laws.

You may use the FMF Website only as permitted by law and as described in these Terms of Use, the Privacy Policy, and other documentation you have been provided by Seattle Children’s related to the Families Moving Forward Program. The content of the FMF Website, including without limitation the files, documents, text, photographs, images, audio, and video, and any materials accessed through or made available for use or download through this FMF Website, may not be copied, distributed, modified, reproduced, published, or used, in whole or in part, except for purposes authorized or approved in writing by Seattle Children’s.

Intellectual Property

Seattle Children’s retains all right, title, and interest in and to the FMF Website, and any information, products, documentation, software, or other materials on the FMF Website, and any patent, copyright, trade secret, trademark, service mark, or other intellectual property, or proprietary right in any of the foregoing, except for information on the FMF Website licensed by Seattle Children’s or owned by another identified copyright holder. You agree not to store, copy, modify, reproduce, retransmit, distribute, disseminate, rent, lease, loan, sell, publish, broadcast, display, or circulate such information except for purposes authorized or approved in writing by Seattle Children’s. Use, reproduction, copying, or redistribution of Seattle Children’s trademarks, service marks, and logos are strictly prohibited without the express prior written permission of Seattle Children’s. The immediately foregoing sentence also applies to any third-party trademarks, service marks, and logos posted on the FMF Website. Nothing contained on the FMF Website should be construed as granting, by implication, estoppel, waiver, or otherwise, any license or right to use any trademarks, service marks, or logos displayed on the FMF Website without the written grant thereof by Seattle Children’s, or the third-party owner of such trademarks, service marks, or logos. The FMF Website may contain other proprietary notices and copyright information, the terms of which you agree to follow.

Use of your Data

Information about how data related to your use of the FMF Website may be used and disclosed is provided in our Privacy Policy. By using the FMF Website, you acknowledge that you have read and agree to the Privacy Policy.

The information available through the FMF Website is for informational and educational purposes and does not constitute medical advice.

The information provided through the FMF Website is believed to be accurate. Furthermore, Seattle Children’s and its affiliates are free to use any ideas, concepts, know-how, or techniques in any communication that you send to the FMF Website, for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products. You acknowledge that you are responsible for all information you send to the FMF Website. You acknowledge that the FMF Website, including the FMF Client Portal, is not intended for storage of identifiable patient information or other sensitive data. You are not permitted to transmit any identifiable patient information or other sensitive information, in any format, to the FMF Website or in electronic communications with Seattle Children’s about the FMF Website. You may not post or transmit any information that is illegal, threatening, libelous, defamatory, obscene, ethnically or racially offensive or discriminatory, profane, infringes the copyright or other intellectual property right of Seattle Children’s or any third party, invades the privacy of another person or any other information or materials that constitute a crime, gives rise to a civil action or otherwise violate any law or confidentiality agreement. Seattle Children’s reserves the right to refuse to post any such message and may take appropriate legal action.

Educational Use

The FMF Website is for professional and educational uses. As a condition to your continued use of the FMF Website, you warrant to Seattle Children’s that you will not use the FMF Website for any purpose that is unlawful or prohibited by these Terms of Use.

No Warranties

USE THE WEBSITE AT YOUR OWN RISK. THIS WEBSITE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. NEITHER SEATTLE CHILDREN’S NOR ITS EMPLOYEES, AGENTS, THIRD PARTY INFORMATION PROVIDERS, MERCHANTS, LICENSORS OR THE LIKE WARRANT THAT THE WEBSITE OR ITS OPERATION WILL BE ACCURATE, RELIABLE, UNINTERRUPTED OR ERROR-FREE. Exclusion of Liability

Seattle Children’s shall provide notice to you promptly of any such claim, suit or proceeding and shall reasonably cooperate with you at your expense in your defense of any such claim, suit or proceeding.

Dispute Resolution

We will try to work in good faith to resolve any issue you have with the FMF Website, if you bring that issue to the attention of our team. However, we realize that there may be rare cases where we may not be able to resolve an issue to an individual’s satisfaction. You and Seattle Children’s agree that any dispute, claim, or controversy arising out of or relating in any way to these Terms of Use or your use of the FMF Website, shall be determined in accordance with the laws of the State of Washington with exclusive jurisdiction and venue for any claims will in state or federal courts located in and for King County, WA.

Please note that we may change or remove functionality and other features of the FMF Website at any time, without notice.
